Haley Joel Osment was arrested at a ski lodge after police received a report of “unruly conduct,” a source tells PEOPLE.
On Tuesday, April 8, the 37-year-old actor was booked for alleged public intoxication and possession of an unidentified controlled substance in Mammoth Lakes, Calif.
A police source exclusively tells PEOPLE on Wednesday, April 16, “The controlled substance right now is presumed to be cocaine. We sent it for testing. We will have the results soon.”
The Sixth Sense star was arrested at the Mammoth Mountain Ski Area at Mill Base Lodge parking lot on April 8, around 2 p.m. local time, after authorities received a call because of Osment’s “unruly conduct” on the mountain, the police source said.
Sergeant Jason Heilman confirmed to PEOPLE, “He was booked and is no longer in custody.”
“Public intoxication and possession of a controlled substance are the charges related to the arrest [on April 8],” Heilman told PEOPLE earlier Wednesday.
Osment wasn’t indicted on the charges filed. The Mono County District Attorney’s Office hasn’t announced whether Osment will face charges. The incident is still under investigation.

The Mono County Sheriff’s Office previously confirmed to PEOPLE that Osment was arrested by the Mammoth Lakes Police Department and provided a mugshot taken after the incident.
Representatives for the actor did not immediately respond to PEOPLE’s request for comment.

The actor has had legal trouble before. In 2018, police were called when Osment had a public verbal scuffle at McCarran International Airport in Las Vegas on Super Bowl Sunday in 2018.
In 2006, when he was 18, Osment was charged with misdemeanor drunk driving after he was injured in a car accident. He later pleaded no contest to one count of driving under the influence of alcohol and one count of possession of marijuana and was sentenced to three years of probation.
